Diploma Thesis from the year 2008 in the subject Economy - Theory of Competition, Competition Policy, grade: 1,7, University of Bonn (Finanzwirtschaftliches Institut), language: English, abstract: The question if and how the ownership structure influences the market value of a firm is one of the most extensive studied subjects in corporate governance. Three main determinants were identified during more than 30 years of research: 1. The size of the block 2. The legal and regulatory environment 3. The type of blockholder This work uses the acquisition of voting blocks by different types of acquirers (point 3) to determine how the shareholder structure in Germany (point 2) influences the valuation of a firm. It is demonstrated that the heterogeneity between block acquirers has to be taken into account, i.e. the size of a block (acquisition) itself (point 1) is not a distinctive enough instrument to determine valuation aspects. The main results are that a block acquisition by banks in Germany results in a negative value effect. A cumulated abnormal return (CAR) of -2.7% in the event-period [-20,20] is the (average) consequence of a block-acquisition by a bank. A strong and highly significant result is the positive valuation effect when hedge funds acquire blocks in their targets. Average cumulated abnormal return is 5% in the period [-20,-1]. Corporations as block-acquirer cause also positive CAR¿s (1%). No significant effects are found following the announcement by mutual funds, insurances and individual investors. The work proceeds as follows: In chapter 2 the literature on general corporate governance and especially the literature concerned with the relation between shareholder structure and valuation is reviewed. The data for this study and its legal sources is described in chapter 3 and chapter 4 gives a short descriptive statistic. The main chapter, chapter 5, starts with an explanation why the event-study methodology is especially eligible to answer the question of how blockholding influences valuation. Then the used methodology is described and the results of the empirical work presented. These are put in the context of the respective literature and research. Chapter 6 is a short summary of the most important findings and concludes the work.

Therefore they should be important to marketers because they are linked to purchase behaviour and sales inseparably (Mitchell and Walsh 2004). Bristor and Fischer (1993) stated, ¿gender is a social concept referring to psychologically, sociologically, or culturally rooted traits, attitudes, beliefs, and behavioural tendencies. Because gender is a pervasive filter through which individuals experience their social world, consumption activities are fundamentally gendered.¿ When Gender Marketing was developed in the United States 15 years ago, it evolved out of the diversity approach. To realize that men¿s and women¿s needs are different and that products are not gender neutral was just a logical consequence out of the practice with differing consumer needs within different ethnical, religious or cultural groups (Flocke 2006). The main goal of gender marketing is to implement differing needs of men and women into the development, distribution, price setting and communication of products and services. Maintainers of this approach consider it as important because of the emerging differences between men and women in their way to articulate consumption desires, making purchase intentions or evaluate products (Flocke 2006). According to Mitchell and Walsh (2004) ¿males and females want different products and they are likely to have different ways of thinking about obtaining these¿ (:331). The aim of this paper is to find out how the commitment to a product is increasing by using gender specific advertisement compared to gender neutral advertisement. Therefore, after a short overview about stated gender differences in the scientific literature, it will discuss three different theoretical models in order to design a testing method: the CVPA (Centrality of Visual Product Aesthetics) as an approach to identify customer concerns about visuals, the selectivity model to discover gender differences in information processing and finally the C-Sconstruct to detect affections to either connected or separated advertisement appeals. After the evolvement of several hypotheses according to the used models the proposal provides a method for testing the stated presumptions and end up with managerial implications and suggestions for further research.

Aus beiden Theorien sind viele Effekte entstanden, wobei der split-attention effect sicherlich einer der bekanntesten ist. Dieser Effekt postuliert, dass die Lernergebnisse für den Lernenden umso besser ausfallen je näher Text und Bild beieinander sind. In einer aufwendigen Online-Untersuchung zum meteorologischen Phänomen ¿Die Entstehung von Blitzen¿ wird experimentell der Frage nachgegangen, ob es nicht auch andere Möglichkeiten zur Verbesserung des Lernerfolgs gibt, ohne Text und Bild nahe beieinander zu platzieren. Mit den neueren Faktoren der Wahrnehmungsorganisation bieten sich an dieser Stelle erstmalig Verknüpfungsmöglichkeiten an, besonders mit dem Faktor der Verbundenheit der Elemente und dem Faktor der gemeinsamen Region. Beide Faktoren werden kombiniert mit der räumlich nahen (integriertes Darstellungsformat) oder fernen (separiertes Darstellungsformat) Darstellung von Text und Bild, um so mit alternativen Möglichkeiten den Lernerfolg zu erhöhen. Zu diesem Zweck werden die Daten von 869 Versuchspersonen zur Beantwortung dieser Fragestellung, in Bezug auf die Lern- und Transferleistung, ausgewertet. Die Hypothese über den Vorteil des integrierten Darstellungsformats kann in dieser Diplomarbeit nicht bestätigt werden, was gegen die Allgemeingültigkeit des split-attention effect spricht. Unterstützend wird die Hypothese verifiziert, dass die verknüpften Darstellungsformate nicht zu schlechteren Lernergebnissen führen, als das integrierte Darstellungsformat. Zusätzlich wird die Hypothese bekräftigt, dass das konstruierte Material passend und die verwendete Animation ohne beschreibenden Text nicht selbsterklärend ist. Als letztes Ergebnis kann sich die Gruppe mit wenig selbsteingeschätztem Vorwissen nicht signifikant vom Rest der Stichprobe unterscheiden, was aber notwendig gewesen wäre zur Bestätigung der Hypothese, dass Novizen mehr kreative Lösungen generieren. Der negative Aspekt des split-attention effect kann damit auch mit anderen Mitteln umgangen werden, als mit der bisher favorisierten Herangehensweise der hohen räumlichen Nähe von Text und Bild. Der Einfluss und Nutzen der neueren Faktoren der Wahrnehmungsorganisation sollte in weiteren Studien zur Cognitive Load Theory untersucht werden.

And "The Fall of the House of Usher", is proved to be a very successful story to demonstrate Poe¿s adherence of his own principle of constructiveness and his structural art. The intention of this research paper is, therefore, to examine how Poe emphasized unity of effect in theory and how it is fulfilled in practice especially in one of his best-known stories. In a close reading of "Usher", the author is above all impressed by the melancholic tone that Poe obviously intends to raise at the very beginning of this story. For this reason, how Poe implements his technique by making tone obedient to the unity of effect will be first of all examined in this paper. Obviously, tone should be identified with atmosphere. According to Poe, unity of setting is another important requirement for achieving the unity of effect in prose writing, which will be studied in the second section. If, as critics maintain, characters are skilfully adapted to the circumstances which surround them are a general device in Poe¿s tales, it is in "Usher" in particular. The third section intends to show how characters are made to fit into the desolate house and dreary environment to achieve the desired effect in this tale. Finally, with the ideal arrangement of effective tone, setting, characters, Poe gains his battlefield to carry out unity of effect in plot in "Usher". In order to attain the unity of plot in literary writing, Poe stressed both "unity of time" and "unity of action", as essential parts in his theory on unity of effect. In "Usher", both of these aspects are completely fulfilled through the brief time span in which the story happens, a coherent plot line and a "mutual relationship" between incidents. Hence, Poe¿s emphasis on unity of plot in theory, and how it is accomplished in "Usher" in the last section will be explored in the last section of this paper. Consistent with Poe¿s theory of "unity", "totality" and "full design", four aspects, namely tone, setting, characters and plot through which Poe attempts to create a vision of "unity of effect" in this tale are examined in this paper.

On the 6th of April 2001 Energie Cottbus was the first club in the Bundesliga that played with 11 non-German players (Kicker, 8th April 2001). This extreme case shows that significant changes have taken place after the ruling. Clubs require more players from other countries, and competition for the superstars of sport has become enormous. The aim of this paper is to identify the changes, which have come up for soccer due to the Bosman case. Therefore the main question will be the following: How did the Bosman-case affect the European football leagues, and especially the top-five leagues (England, Italy, Spain, Germany and France)? In order to answer this question many different dimension have to be taken into consideration, since the Bosman case revolutionized football in more than one way. Thus aspects, which have to be mentioned here, include the changed number of foreign football players in the European leagues, the new transfer system, the new competitiveness situation as well as the financial development of the clubs. Sub-questions, which need to be answered in order to support the main questions, are: What is the historical relation between the EU law and sport law? What exactly is the content of the Bosman case? Which additional sport cases where decided by the ECJ after the Bosman ruling? How did the clubs react to the changed rules? Where the players able to benefit from the Bosman ruling, and if so how exactly? Has the competitive balance situation changed after Bosman? Are there also other reasons that can explain a changed situation? In the first part the question about the exact relation between the EU and the sport law will be answered. Sport still enjoys a certain freedom and can implement rules and laws, which are limited to the field of sport, but the EU is driving back this freedom. Thus measures and statements, which were taken by EU officials, will be examined, in order to show why the Bosman case was possible. [...]

Hungary, Czech Republic and Poland choose a different approach to this issue, because they implied different strategies. Actually you can speak about three different privatisation scenarios. Auf Deutsch: Alle drei Länder haben 1989 am gleichen Startpunkt angefangen, sie mussten nämlich Marktwirtschaftreformen und Privatisierung durchführen. Kurz nach dem Start haben sich aber ihre Wege getrennt. Nach 17 Jahren kann man von über 3 verschiedenen Privatisierungsbeispielen sprechen. Dieses Thema ist ziemlich unfangreich, deshalb möchte ich mich nur auf den Underpricingeffekt in Polen, Ungarn und Tschechien konzentrieren. Meine Ergebnisse zeigen, dass dieser Effekt in diesen 3 Ländern unterschiedlich stark ist und die Privatisierungsmethode ihn beeinflussen könnte. Auf der ungarischen und polnischen Börse kann man die ¿heissen¿ und ¿kalten¿ Phasen erkennen. Ziemlich unüblich ist, dass man den ¿money left on the table¿-Effekt in Polen beobachten kann, aber die Geldsummen minimal sind.

Conventional methods to avoid OFDM adjacent channel interference are not only insufficient but also are wasting a lot of frequency resources. In this research, a method using combinations of modulation schemes is proposed to avoid effects of OFDM adjacent channel interference. It can be obtained by modulating the sub-carriers at the outer sides of an OFDM channel with lower order modulation schemes (such as BPSK or QPSK), while modulating the sub-carriers at the inner side of the OFDM channel with higher order modulation schemes (such as 16QAM or 64QAM). Intensive simulations have been carried out to evaluate the performance of the proposed method. The simulation results have shown an increase in the OFDM system¿s resistance against adjacent channel interference while still maintain the bandwidth efficiency.

Average economic growth rates within the two digit range over the past 30 years, an enormous market with more than 1.3 billion people and economically backward areas woke the pioneer spirit of western gold diggers. The Chinese population is by far bigger than those of the European Union, the United States, Australia and Canada together. In addition to this it comes that China was up to 30 years ago not only ruled by communism, but also robbed of its thousands of years-old traditions by the maoistic Cultural Revolution. The question is how it was possible that this country could ascend in such a short time to one of the most successful economies in the world. That a certain cultural value system or ethics is a fundamental basis for the economic acting of a nation was already determined by Adam Smith in his work ¿An Inquiry into the Nature and Causes of the Wealth of Nations¿.1 Max Weber also built up on this realization (see chapter two). The following work would like to approach this phenomenom from the cultural point of view and follow the question, which cultural bases rule in the Chinese society. This should be tried by a short representation of the most important schools of thought in China, which cannot happen finally because of the compendiousness of the work. Rather it should be understood as a suggestion for thinking about Chinese culture and its differences. Also this work will not take culture-theoretical factors as a basis for analysis. Rather it is to be tried to represent the most important differences between the European and the Chinese culture and to sensitize for this. It is not an aim of this resignment to set up regularities of the Chinese character but to refer to possible differences.

Wilde was born in 1854 and died of cerebral meningitis in 1900. "The Importance of Being Earnest" was his final and most lasting play - "by all accounts, a masterpiece of modern comedy."1 This play is filled with wit and wisdom, which Wilde himself wrote of it, too. "Well I think, an amusing thing with lots of fun and wit might be made."2 It represents Wilde¿s late -Victorian view of the aristocracy, marriage, wit and social life. The play tells the story of Jack Worthing and Algernon Moncrieff. Both men lead a double life. One in the country and one in the city. Then, they both fall in love, and a series of crises threatens to spoil their romantic pursuits. The main plot line of the play is definitely marriage. "Of course Wilde pokes fun at the institution of marriage, which he saw as a practice surrounded by hypocrisy and absurdity."2 He focuses on the higher class and satirises the life of the English aristocracy. His characters are typical Victorian snobs who are arrogant, overly proper, formal and concerned with money. This essay will provide an outline of the comic effects in this play. How Wilde uses humour, satire, farce and irony. The analysis will show, what makes this comedy so funny and so special. The essay will show some combinations of dialogue, dramatic irony, social criticism, characterisation and exaggeration and it will prove that the dialogues with its puns and epigrams are the basis for the humour in Wilde¿s last play.

Setting of from the assumption that Freud's ground-breaking claims must have found their way into the complex, allusion-laden writing of his contemporary Joyce, it works out elements in the hallucinatory "Circe" chapter that refer to Freud's theory on dreams, concentrating specifically on the portrayal of Bloom. After an overview of the central aspects of Freud's Interpretation of Dreams, the structure of "Circe" will be introduced, justifying the analogy to dreams and tackling the general problem of applying psychoanalysis to literary criticism. The next chapter will take a closer look at Freud¿s idea of regression and enumerate elements that may be considered allusions to this in ¿Circe¿. Building on this, the final chapter will then be an attempt at a psychoanalytic reading of Bloom, also drawing upon some additional ideas from Freud¿s later theories.

Her fiction reflects facets of her mixed heritage: she is German-American by her father, as well as French and Ojibwa (also known as Chippewa or Anishinaabe) by her mother. Louise Erdrich left North Dakota in 1972 and entered Dartmouth College in New Hampshire, where she met Michael Dorris, a mixed-blood Modoc Indian writer who founded the Native American Studies department at the college. Collaboratively, they published "Route Two" (1990) and "The Crown of Columbus" (1991). Erdrich and Dorris married in 1981, but were in the midst of divorce proceedings when he committed suicide in 1997. ¿I knew that Michael was suicidal from the second year of our marriage,¿ Erdrich said in an interview. The award-winning writer is considered to be one of the most significant Native American novelists from the ¿second wave¿ of what is called the Native American Renaissance (see chapter 1.2). She is an enrolled member of the Turtle Mountain Band of Ojibwe. ¿No one knew yet how many were lost, people kept no track.¿ (Tracks, p. 15) "Tracks" (1988) Erdrich¿s novel Tracks, which is to be explored in the present argument, is the third part of an initially planned tetralogy, including "Love Medicine" (1984), "The Beet Queen" (1986), and "The Bingo Palace" (1994). Louise Erdrich created a novel cycle, exploring the lives of various generations of Chippewa family who live on a fictional reservation in North Dakota in the twentieth century, a time when Indian tribes were struggling to retain their remaining land. Chronologically speaking, it is the family¿s earliest period¿from 1912 to 1924¿that is related in Tracks. In most of her works, Erdrich uses several characters to narrate alternating chapters, presenting a story that unfolds from multiple perspectives. "Tracks" is told retrospectively by two homodiegetic narrators: Pauline Puyat, a mixed-blood who denies her Indian ¿half¿ in order to be accepted into the convent and changes her name to Sister Leopolda, and Nanapush, an older Native American who tells his story to a named addressee, his granddaughter Lulu: ¿You were born on the day we shot the last bear, drunk, on the reservation.¿ ("Tracks", p. 58) "Tracks" is constructed as mutually referential focalization, ...

To walk is to vegetate, to stroll is to live.¿ (Balzac, "Physiologie du Mariage") 'City of Glass' is Paul Auster¿s first novel, published in 1985, after being rejected by several publishers. The first part of 'The New York Trilogy' has been translated into 17 languages so far, a fact that pleads for the novel¿s commercial success nowadays. An indication for the literary importance of 'City of Glass' is the continually growing number of essays, anthologies and monographs all over the world. It is undeniable that its selling success is related to the general fascination for the cosmopolitan city of New York and for detective stories, as ¿ at first sight ¿ Auster¿s novel follows the tradition of Edgar Allan Poe. However, he follows the tradition ¿as creator of ¿the lost ones¿¿, as ¿ on closer inspection ¿ the reader has to realize that the real mystery is one of confused character identities and realities. 'City of Glass' does not meet the reader¿s expectations about a typical New York ¿city novel¿: Auster created an adequate text for a modified, postmodern cityscape where all objects of the city seem like linguistic codes that need to be deciphered. The risks of the city result from the confusion of language and perception. The fear of an identity collapse comes along with the apparent collapse of the cityscape. Auster picks out the loss of stability and security in the city as central theme. He describes a world begging for order and interpretation where ¿nothing is real except chance¿. (...) Auster's character Quinn is a deconstructed character of postmodernism, he acts like a 'flâneur', but does not feel comfortable while walking through the city, he seems lost. New York is the ¿nowhere¿ Quinn has built around himself. Professor Stillman also seems to stroll like a 'flâneur', but he has to fulfill an operation (in contrast to the ¿classical¿ 'flâneur' who has no aim). Auster deconstructs the postmodern figure of the flâneur as he deconstructs the classical detective novel. Ironically, these very deconstructions help to shape the novel. Quinn can be read as flâneur adapted to a postmodern world, I argue. In the following, I will explore the relations between Auster¿s 'City of Glass' and concepts of 'flânerie', strolling urban observing. In order to discuss 'flânerie' in Auster¿s work, it is essential to take a closer look on the term first. (...)

The problem is that incumbent politicians can manipulate the electoral system in such a way as to ensure victory during next elections to preserve their power. Kyrgyzstan is precisely such a case. Although, during 14 years of country¿s independence the electoral system has undergone major transformations three times, the current electoral system can hardly be named democratic. Furthermore, after the Kyrgyz opposition took over power on 24th March, 2005, one of the first requirements of the civil society was revision of the constitution, including reformation of the electoral system. Having come across The New International IDEA Handbook on Electoral System Design, it became increasingly interesting for me to make an attempt to design the electoral system for Kyrgyzstan to make it more democratic. Apart from using the handbook on Electoral System Design, the methods of research include analysis of reports of international organizations such as OSCE and ICG related to the topic. Hypothesis of the author is the following. In order to ¿democratize¿ Kyrgyzstan, i.e. to make the decision-making process more inclusive, to ensure that majority of voices is heard, and to secure that regional, clan and minorities¿ interests are taken into account, it is necessary, inter alia, to introduce Parallel electoral system, i.e. half of the seats in the parliament is to be elected by FPTP run-off in single-member constituencies while the other half of the seats is to be elected by PR closed party lists.

Bezüglich des Value- und Growth-Investments wurden zahlreiche empirische Untersuchungen veröffentlicht. In einem aktuellen Artikel heisst es, dass die Anleger, die sich auf das Value-Investing als Strategie der weltbekannten Value-Investoren Peter Lynch und Warren Buffet berufen, als "stille Geniesser" bezeichnet werden. Die empirischen Ergebnisse, die vor allem in den neunziger Jahren sowie Anfang 2000 erstellt wurden, sollten in den Anlagestrategien heutiger Zeit berücksichtigt sein. Zudem wurden am Markt diverse Indizes integriert. So dienen der MSCI Value/Growth, der Dow Jones Stoxx TMI Value/Growth und der Salomon Smith Barney Value & Growth Index als adäquate Benchmark für die Performancemessung. Dass die Bedeutung dieser Investmentstile in der Öffentlichkeit weiter zunimmt, zeigt die stetige Auflage neuer Fonds, die sich dieser Anlagestrategie verschrieben haben. Fortlaufend steigende Bestände in diesen Fonds unterstützen die These. Sowohl der DWS Top Dividende als auch der UniDividendenAss der Union Investment können innerhalb Deutschlands mittlerweile Investmentgelder in Höhe von jeweils 1,5 Mrd. EUR auf sich vereinen. Diese Seminararbeit soll dem Leser zeigen, welche Kriterien angesetzt werden und zu welchen Ergebnissen internationale Studien hinsichtlich der Performanceentwicklungen gekommen sind. Jahrhunderts im US-amerikanischen Rechtsraum im bekannteren Masse auf. Dies ereignete sich im Zusammenhang mit einer Preisregulierung durch ein richtungweisendes Urteil zur Bemessung von Fahrkartenpreisen. Der amerikanische Surpreme Court verfügte im Fall Smyth vs. Ames 1898 den Grundsatz, dass der Eisenbahngesellschaft ein "fair return on fair value" zusteht. Das Gericht sah eine Ermittlung der Preise unter anderem auf Basis künftiger Erfolgsgrössen vor. Damit etablierte sie früh ein ökonomisches Wertverständnis für den Fair Value. Das Wort fair beinhaltet hier die Gerechtigkeitsvorstellung, da im Vordergrund stand, dem öffentlichen Unternehmen eine "fair compensation for the services rendered" zukommen zu lassen.1 Die kapitalmarktorientierte Rechnungslegung, insbesondere die International Financial Reporting Standards und die US-amerikanischen Generally Accepted Acounting Principles, zeichnen sich durch die seit Ende der 1980er Jahre weiter voran schreitende Hinwendung zur Zeitbewertung aus.2 Die Implementierung des Fair Value als Wertmassstab für Finanzinstrumente, in der jüngeren Vergangenheit aber auch zunehmend für nicht-finanzielle Positionen, wird als ein Anzeichen eines Paradigmenwechsels aufgefasst.3 Dies deutet auf eine nachhaltige, von festen Überzeugungen auf Seiten der normsetzenden Gremien getragene Entwicklung hin.4 Dieser Trend wird durch die Verbindlichkeit börsennotierter Unternehmen unterstrichen, die seit 2005 ihren Konzernabschluss -im IFRS im 315a Abs. 1 und 2 des HGB geregelt- aufzustellen haben. Zu dem kann ein Mutterunternehmen, das nicht börsennotiert ist, vom Wahlrecht nach 315a Abs. 3 HGB Gebrauch machen, ob es den Konzernabschluss nach IFRS aufstellt, dass sich aufgrund einer Vergleichbarkeit auf einem globalen Markt anbietet.

Customers and consumers are increasingly value driven. In this challenging world, there is a growing recognition that creative pricing strategies combined with effective supply chain management provide opportunities for significant risk capital cost reduction and yet increased profits. This paper presents evidence and a new model to support this viewpoint and suggests an approach to supply chain alignment that can enable cost reduction opportunities to be identified and higher profits to be achieved through collaborative strategies. For a good risk management the bank uses, among other figures, RORAC, RAROC and RARORAC to minimize the risk that each credit-borrower brings along. In the financing sector, therefore, they created the credit-ranking system. Now the next question would be, why not implement that credit-ranking in logistics to minimize risks in order to create a certain risk capital as security. Especially in the airfreight segment, where there is a lot of environmental risk involved, there has to be created a new way to prevent from high unexpected losses.
