Seminar paper from the year 2004 in the subject English Language and Literature Studies - Linguistics, grade: 1-, University of Dusseldorf "Heinrich Heine" (Anglistisches Institut), course: Domain Specific English Language - Language and Law, language: English, abstract: The English language has taken over the key role in international trade, legislation and policy-making. It has achieved "the enhanced status [¿] as the dominant world language [which] has led to an increased demand for the training of competent specialists able to mediate" (Alcaraz Varo/Hughes, 2002: 1). This goes along with a "phenomenal increase in the teaching of [¿] 'English for special (or specific) purposes' " (ibid.: 2). What is the reason for this development? This piece of work might give an answer; it dedicates itself to domain specific English language: language and law. It concentrates on the characteristics of the structure of legal English in particular. An overview of the central structural features is given, without claiming completeness. Legal professionals aim at a precise explanation of facts which should leave no doubts. This aim forces them to use a certain kind of language pattern, such as including a high amount of definitions in legal texts, along with numerous complex and ancient phrases deriving from Law French and plentiful enumerations which can all together form a single sentence covering several lines. Dependent on which party they represent, lawyers make frequent use of features that reduce the agent in his identity while emphasizing the action ¿ a matter of strategy which has the impeding of comprehension as a consequence. Therefore, the field of law becomes completely unapproachable for laymen, who are scarcely able to follow legal discourse. Even well-educated native speakers often find it hard to understand the language used in court. However, the access to one¿s rights is important. To begin with, the reader will be provided with an overall definition of special languages and an explanation why to regard them as a variety of a language; afterwards this will be illustrated at the example of the language of the law. Subsequently, the foundations for the structural analysis of legal English will have been laid. Language has to serve as the vehicle for transporting what the law is about. But legal language does not seem to be a good packaging of legal contents. That is why experts are asked to diminish the barrier and mediate between the language of the law and common speech. Does legalese function as an obstacle rather than a vehicle then? This question will have to be considered in this piece of work. Seminar paper from the year 2007 in the subject American Studies - Literature, grade: 2, Martin Luther University (Institut für Anglistik und Amerikanistik), course: Proseminar: Germany and the Germans in American Short Fiction, language: English, abstract: In the following paper I am going to analyze Twain¿s incomparable and particular usage of humor in his essay The Awful German Language. Therein, Twain uses humor as an instrument to criticize the German language. Without its witty and diversified character the essay would be a provocative and mean accusation. I will support my thesis with the help of additional information about the author¿s biography and his first experiences with the German language. To explain my thesis and to understand the author¿s concerns it is important to draw these connections. Moreover, I will go into detail about the essay structure to illustrate its critical character and effect. The large amount of stylistic devices that make the essay particularly impressive and remarkable will be parsed and discussed in addition. Eventually, I will comment on the essay¿s impact on success and distinction. In doing so, the sustainability of this piece will be explained.

Seminar paper from the year 2006 in the subject English Language and Literature Studies - Linguistics, grade: 1,0, Free University of Berlin (Institute for English Linguistics), course: Second Language Acquisition, 23 entries in the bibliography, language: English, abstract: One of the central questions that SLA has tried to answer is why learners of a non-native language (L2) evince such a high degree of interindividual variation in their final attainment relative to the L2 components and skills they have acquired. In order to offer a satisfactory response to this key issue, SLA researchers have posited the existence of a set of individual factors of a very different nature, such as aptitude, motivation, attitude, personality, and intelligence, among others, that might explain such variation. However, one of the most obvious potential explanations for the lack of success of L2 learners compared to L1 learners is that the acquisition of a foreign language begins at a later age than that of the mother tongue does. Thus, it has been prevalently assumed that age itself is a predictor of second language proficiency. This paper focuses on research which has been carried out on maturational constraints for SLA and hereby tries to find answers to various questions concerning age as a factor in SLA.

Seminar paper from the year 2002 in the subject Law - European and International Law, Intellectual Properties, grade: A, University of Lapland, 11 entries in the bibliography, language: English, abstract: Looking at the character of the legal system it can be recognised that there are elements of many different legal systems, for instance state, federation, international organisation. Especially from the Treaty of Maastricht in 1992 on there are is a tendence towards a closer unification visible, as the establishment of the European Union and the current debate about a constitution show. The extent to which the examination of the legal character takes place is, due to the length of the essay and the large number of features of the legal system, a brief one, which can naturally not take in account all the possible arguments. It looks at 8 categories, which can give good evidence to solve the question of the legal character of the EU.

Scientific Essay from the year 2008 in the subject Law - Comparative Legal Systems, Comparative Law, grade: High Distinction, The University of Adelaide, language: English, abstract: A Corporate rescue Generally speaking, the corporate rescue process and the liquidation procedure form the two basic columns of a modern insolvency regime.(2) Whereas the Australian legislator expressly implemented these two procedures the German legislator codified a uniform insolvency process. An effective corporate rescue procedure is a cornerstone of a prospering economy. Economical value is closely connected to the risk of economic loss. Therefore, economic growth will only be sustainable if investments are supported by safeguards donated by effective insolvency regimes not only focussing on a fast liquidation but also on the reorganisation or rescue of a company. Only the careful balance of creditors¿ rights and the entrepreneurial spirit of the debtors ensure attractiveness for investments.(3) B Comparative approach This essay is focussed on the administrator as point of comparison because his role in the process significantly reflects the principles of the underlying corporate rescue regime. In both countries Australia and Germany the administrator is a relatively influential organ. The essay will show that the role of the German administrator is much more influenced by the court than in Australia. The essay¿s goal is to examine selected issues concerning the Australian and German administrator. After presenting the different roles in the Australian and German corporate rescue process the essay will critically review the role of the administrator in both regimes in order to examine the effectiveness of the process from a comparative point of view. ********* (2) See United Nations Commission on International Trade Law, Legislative Guide on Insolvency Law (2005) 14, recommendation 2. grin privatization in russia

Seminar paper from the year 2007 in the subject Politics - International Politics - Region: Russia, grade: A, York University, language: English, abstract: ¿Fragmentation of state authority, lack of a clear legislative base, unreliability of the legal system, collapse of the industry, bisection of the GDP, runaway inflation, capital flight, rises in crime and corruption, tremendous decline in life expectancy: the political, economic and social results of Russiäs transition from plan to market under Yeltsin are devastating. Within a few years the ¿mighty¿ Soviet Union fell back from a major power to a third world economy, dealing with problems like mass poverty and epidemics. In light of these disastrous outcomes the question of what ¿went right¿ during the transition process seems to be even more appropriate then the question of what ¿went wrong¿. However, while it seems to be obvious that the stabilization and liberalization attempts by the Russian government predominantly failed, privatization, the third core facet of transition1 , ¿has been touted as a one of the major successes of the Russian government¿s economic transformation policy. By the beginning of 1996 77.2% of medium-size and large enterprises had been privatised, accounting for 88.3% of total industrial output.¿2 On the one hand, according to the Russian government¿s Western advisers this privatization is the fastest in human history and ¿seems to be one of the few positive fruit of Russian economic policy since 1991¿3. On the other hand, a common point of view is that its implementation led to an unfair distribution of state assets and only benefited a minority of Russian population. This debate is going to be the main focus of this paper. By discussing the general importance of the private sector to a democracy, the aims of privatization, its subsequent reforms, and its results, I intend to assess the contribution of these reforms to the process of Russian democratization.

Seminar paper from the year 2008 in the subject Sociology - Political Sociology, Majorities, Minorities, grade: 1,0, European University Viadrina Frankfurt (Oder), language: English, abstract: In the last decades, debates about the existence and the meaning of an European idetity raised all the time more. Some scholars approached the theme, focussing on a ¿common historical heritage¿, which points to a basis for a collective identity (Habermas 2001; Giesen 2003), others based their arguments on political and institutional similarities among European countries like human rights protection, democracy and rule of law (Risse 2001). In other cases, the studies on the topic focussed on the ambivalent employ of the term ¿identity¿, arguing its (ab)-use, above all in EU-Treaties, instead of more obviously expressions as ¿legitimacy¿ or ¿sovereignty¿ (Bruha/ Rau 2000). The aim of this paper is to examine the topic from two distinctive perspectives: a post-national and a postmodern. The paper suggests a sort of ¿back to the roots¿ of the en-quiry, approaching the subject neither with pre-existent assumptions nor with the goal to order puzzled arguments. The study will not pursue the question about the existence of a collective European identity, but will search for possible ways and circumstances, in which ¿identity¿ in Europe (restricting the focus on the European Union) may emerge. The central question of the paper will be if the development of an European identity is plausible and if a widespread process of socialisation may prevail on the national structures of the member states (hereafter MSs) and lead to the growth of common ¿procedures¿ and ¿functions¿ among European populations. In order to answer the question the more satisfactory as possible, the dissertation proposes two differing angles for the analysis with the intend to compare the findings resulting from dissimilar criteria of examination. In a first part the EU will be considered as a post-national political order, deriving from the dissolution of its MSs. After a short explanation on the political nature of the Union from this standpoint, the dissertation will explore the option of an emerging post-national identity in the European Union, adopting the criteria proposed by Anthony Smith in his study of national identities (Smith 1991). The analysis will evaluate if the EU attends the proposed criteria in order to assess the coming out of a post-national form of social identification. [...]

Seminar paper from the year 2007 in the subject Business economics - Business Management, Corporate Governance, grade: 2,1, University of Sunderland (University of Sunderland), course: Contemporary Management, language: English, abstract: After five years of vast losses, especially for the IATA Carrier, which are all scheduled airlines, 2007 will be a successful year for the airline industry, with a forecasted profit of $8.5 billion. The early 21st century marked the industry with high losses and consolidation. Due to the reason that the industry sector highly depends on the external environment: the terrorist attacks of September 11th 2001, magnified by the weak economic conditions in many major countries and more recently the Iraq War and SARS epidemic, have made the last five years unhappy ones, especially for most of the schedules airlines. In addition to that, the liberalisation of the European aviation market enabled low cost airlines to reshape the competitive environment and to make significant impacts in the world¿s domestic passenger markets, which have previously been largely controlled by full service carriers. The overall market situation is dominated by increasing pressure on cost and productiveness. The global market trend forces a high company concentration that strengthens market positions. Lufthansa - Germany¿s national carrier was faced, like all other national carriers with the above-mentioned problems and had to find its way out of the crisis. The central question of this report is: With which tools did Lufthansa solve these problems? And are these tools sufficient to be competitive for future developments? This report paper is dealing with the developments in airline business illustrated with the example of Germany¿s national carrier, the Lufthansa AG, and the enormous company restructuring toward an ideal global player in a highly competitive environment. By analysing the internal and external influences, pressuring the company to adapt, the need of change by Lufthansa will be made more comprehensible. The learning organisation and the role of creativity have become more important during the last decades, especially in fast changing environments like the airline industry where Lufthansa operates. This will be a special regard in chapter four. In the last section of the report a critical analysis will be made on the effectiveness of the organisation¿s response, and some areas of improvement will be mentioned.

Seminar paper from the year 2008 in the subject Engineering - Civil Engineering, grade: A, University of California, Berkeley , language: English, abstract: In 1894 the British architect John Tavenor wrote an article about the remains of medieval architecture in the Baltic area. He concluded that the style in this area has been carried throughout the Middle Ages and further stated that the style is ¿quite dissimilar to those of the rest of the continent¿ , meaning the Gothic style, that started to spread over Europe in the 11th and 12th centuries. He calls this architecture the ¿Baltic style¿ and considers it to be a sub-style of the Gothic style. The Holy Roman Empire, which contributed to the spread of the Gothic style, only reached as far as the Elbe River in Germany. The Baltic area, as the heart of Northern Europe, was fractured into many kingdoms, principalities and lordships in the 1st millennium B.C. So how was it possible that cultural and economic goods could spread in these disadvantageous circumstances, at a time when ¿commerce by sea was little more than outrageous piracy and commerce by land was obliged to follow one or two beaten tracks across Europe in order to escape merciless exactions of the robber barons¿ ? One answer could be the Hanseatic League, a protected network created by merchants, in order to protect their trade. This alliance allowed trading guilds to manifest a trade monopoly within the entire Baltic area. Since the League was not tied to any sphere of control but the merchants themselves, trades could be made easily within Northern Europe. Consequently the simultaneous appearance of the League and the Baltic style suggest that there is a possible correlation between the architecture in the Baltic area and its spread along the Hanseatic League¿s trading routes. During this essay I am going to support this assumption by finding exemplifying similarities among buildings in the Hanse towns along the main trading routes. [...]

Seminar paper from the year 2008 in the subject Didactics for the subject English - Literature, Works, grade: 1,0, University of Augsburg (Englische Literaturwissenschaft), course: James Joyce, language: English, abstract: This paper analyses the nighttown episode of Joyce's Ulysses through the framework of Freud's psychoanalytic understanding of dreams. Setting of from the assumption that Freud's ground-breaking claims must have found their way into the complex, allusion-laden writing of his contemporary Joyce, it works out elements in the hallucinatory "Circe" chapter that refer to Freud's theory on dreams, concentrating specifically on the portrayal of Bloom. After an overview of the central aspects of Freud's Interpretation of Dreams, the structure of "Circe" will be introduced, justifying the analogy to dreams and tackling the general problem of applying psychoanalysis to literary criticism. The next chapter will take a closer look at Freud¿s idea of regression and enumerate elements that may be considered allusions to this in ¿Circe¿. Building on this, the final chapter will then be an attempt at a psychoanalytic reading of Bloom, also drawing upon some additional ideas from Freud¿s later theories.

Essay from the year 2003 in the subject Politics - International Politics - Topic: Peace and Conflict Studies, Security, grade: 2 (B), University of Kent (Brussls School of International Studies), course: Negotiation and Mediation, 16 entries in the bibliography, language: English, abstract: Since the end of the Cold War the nature and perception of international conflict has changed significantly. Instead of inter-state war, intra-state conflicts now constitute the majority of current conflicts. "Global nuclear warfare is no longer the primary international security concern. It has been displaced by [...] excessively violent and destructive intra-state or internal conflicts." And these conflicts, which would have been regarded as purely internal matters during the Cold War, are now seen as being of international concern. Civil wars which are normally regionalised, are often nevertheless deemed to be a threat to international peace and security. As a result, the international community has become more and more involved in the resolution of civil wars, often by mediating peace negotiations between the parties involved. However, the resolution of civil war is one the most challenging tasks in Conflict Resolution. Only a minority of negotiations result in a lasting peace and only under exceptional circumstances is this achieved without a third party mediating the negotiations. Although many of the attempts to settle civil wars by mediation have failed, it is clear that the involvement of international mediators makes civil war negotiations more likely to succeed and in some cases indeed helps to find long-term solutions to the conflict.

Scientific Essay from the year 2008 in the subject Business economics - Economic Policy, , language: English, abstract: School based general education aught to be a future oriented subject. However, over the years, due to parental and grand-parental generations setting policies of education for the younger generation, education is always more past oriented than future oriented. This trend did not cause much of a problem when the change over time was moderate. As Alvin Toffler (1970) says we are in a turning point of human history. In the changing perspective in the world with speed of change, speed of inventions and speed of knowledge and speed of threat on living education got to change to prepare the next generation to face these new challenges. The climatic change, depletion of resources, growing energy crisis, threat of terrorism, rapid of growth of population and the changing structure of population are new challenges the young generation would face. The world in year 2050 would not be a different place to live. Unless and otherwise education policy is framed to address the 'gloom and doom' side of world by 2050, the next generation would face a serious threat of existence. The positive futurists show that technology and science will not allow the world to laps its primitive past once again. It is clear that science and technology is the only answer to human survival. Therefore, it is important that education policy makers taking a fresh look at the policy challenges for the future. This paper makes an analysis based on the published and documented evidence what policy framework would be required in the developing countries in view of the emerging challenges to ensure a survival of the generations to come.

Essay from the year 2002 in the subject Geography / Earth Science - Physical Geography, Geomorphology, Environmental Studies, grade: 1.1 (A), Oxford University (New College), 6 entries in the bibliography, language: English, abstract: Fertility is directly determined by so-called intermediate fertility variables or proximate determinants which are, in turn, affected by indirect determinants such as socio-economic, cultural and environmental variables. Many different proximate determinants influence fertility and the relationship between them and the level of fertility can be analysed using a comprehensive model. The result of this analysis shows that variations in four factors - marriage, contraception, lactation and induced abortion - are the primary proximate causes of fertility differences among populations. While fertility variations can always be traced to variations in one or more of the intermediate variables, the scope for variation differs among the variables as does their degree of influence in different societies and over time within societies.

Seminar paper from the year 2009 in the subject Didactics - English - Pedagogy, Literature Studies, grade: 2,0, University of Freiburg (Englisches Seminar), course: Contrastive Linguistics, language: English, abstract: When German native speakers converse with English native speakers, they are often astonished how easily and spontaneously new words can be created in English. At the same time, English speakers are astonished by the number of lengthy compounds the German use in written language. But still, most word formation processes are very similar in both languages - both English and German even share some affixes, for example be- in be-friend or be-zahlen or ¿er in sing-er or Säng-er. I want to investigate the differences and similarities concerning the major word formation processes in English and German (compounding, derivational suffixation and conversion). Firstly, I will provide an appropriate background by looking at contrasts in the lexicon and will also touch on some diachronic explanations. Then I will explain the different units of words. Ultimately, I want to get an insight into a very recent phenomenon, namely the adding of German affixes to English words in German word formation - the so-called ¿Denglisch¿.

grin human rights in european

Essay from the year 2001 in the subject Politics - International Politics - Topic: International Organisations, grade: 1.3 (A), University of Leeds (POLIS), language: English, abstract: Europe has got a long tradition of human rights. Actually, the idea of "the inherent dignity and of the equal and inalienable rights of all members of the human family" as laid down in the Universal Declaration of Human Rights of the United Nations is said to have its historic origins in ancient Greek philosophy and Roman law. The first official declarations of human rights, starting with the English Bill of Rights of 1688, all stand in this tradition. Hence, it is not far-fetched when Europeans see themselves as defenders of human rights principles on the international scene. Especially the European Union¿s self-perception has moved in this direction. With the end of the Cold War, the right time seems to have come for politics that increasingly take into account, defend and even fight for such values: the war of the North Atlantic Treaty Organisation with Yugoslavia is only one example of this tendency. But it is a good example, because the "humanitarian catastrophe" that was triggered by Western air-strikes also highlights the fact that the "new Europe" is far from being an examplary place where human rights are widely respected. The essay examines in a critical way the extent to which politics in the pre-9/11 "new Europe" were actually characterised by human rights principles. The foundations of these principles in the "old Europe" will be considered, as well as the double challenge to politics brought about by the fall of the Berlin wall and how this challenge has been met in the 1990s by political institutions (EU's internal and external human rights policies, NATO). The essay concludes with a discussion of the universality claim of human rights in an Western-dominated and internationalised world. The essay critically reviews facts and fiction of European human rights policies on the pre-9/11 international scene.

Seminar paper from the year 2005 in the subject Business economics - Accounting and Taxes, grade: 1,0, University of Applied Sciences Eberswalde, 10 entries in the bibliography, language: English, abstract: By writing this report I would like to introduce the reader into the topic of deferred taxes by using the International Accounting Standard 12. Therefore I would like to introduce you into the topic deferred taxes by giving you the theoretical basic concept of deferred taxes. The theoretical basic concept of deferred taxes should give you the idea and a definition of deferred taxes. Afterwards I would like to present the different causes for creating deferred taxes. The causes for creating deferred taxes will be emphasized by give examples. For a better understanding I would like to explain in the following the steps the methods of determination. You have to know that the IAS determines the deferred taxes by using the temporary concept. Because I would like to underline the differences I will present in short form the timing concept too. The temporary concept includes the timing and the temporary differences and excludes the permanent differences. Now we have to find a definition for each type of difference. If we know the idea of deferred taxes and we know how to determine them, we will be interested in the evaluation of deferred taxes. Therefore I will describe the liability method used by IAS and to show the differences I will describe the deferred method. For a better understanding I would like to conclude my report by giving the different way of calculation deferred taxes by using the deferred method and the liability method.
