Actually, the idea of "the inherent dignity and of the equal and inalienable rights of all members of the human family" as laid down in the Universal Declaration of Human Rights of the United Nations is said to have its historic origins in ancient Greek philosophy and Roman law. The first official declarations of human rights, starting with the English Bill of Rights of 1688, all stand in this tradition. Hence, it is not far-fetched when Europeans see themselves as defenders of human rights principles on the international scene. Especially the European Union¿s self-perception has moved in this direction. With the end of the Cold War, the right time seems to have come for politics that increasingly take into account, defend and even fight for such values: the war of the North Atlantic Treaty Organisation with Yugoslavia is only one example of this tendency. But it is a good example, because the "humanitarian catastrophe" that was triggered by Western air-strikes also highlights the fact that the "new Europe" is far from being an examplary place where human rights are widely respected. The essay examines in a critical way the extent to which politics in the pre-9/11 "new Europe" were actually characterised by human rights principles. The foundations of these principles in the "old Europe" will be considered, as well as the double challenge to politics brought about by the fall of the Berlin wall and how this challenge has been met in the 1990s by political institutions (EU's internal and external human rights policies, NATO). The essay concludes with a discussion of the universality claim of human rights in an Western-dominated and internationalised world. The essay critically reviews facts and fiction of European human rights policies on the pre-9/11 international scene.

This book analyzes the practice of Russia honoring her legal obligations under the European Convention of Human Rights (ECHR): to secure to everyone within its jurisdiction the rights and freedoms defined in the Convention (Article 1 of the ECHR). The study comes to the conclusion that the impact of the ECHR on the Russian legal system, in terms of its implementation by domestic courts, is unsatisfactory. The jurisprudence of the Supreme Court and Supreme Arbitration Court is an attempt to demonstrate to the Council of Europe that the ECHR is being applied, rather than to implement the ECHR. In contrast, the jurisprudence emerging from decisions of the Russian Federation’s Constitutional Court and district courts indicates a better understanding of the spirit of the ECHR. Still, the rare instances in which domestic courts implemented the ECHR were, more often than not, prompted by applicants’ arguments based on ECHR case-law, rather than by the courts. The book suggests methods of ensuring a more effective implementation of the ECHR’s provisions within Russian national law. It develops recommendations on how to assess the Russian government’s compliance with judgments of the European Court of Human Rights, and how to interpret explanations submitted by Russia to the Secretary General of the Council of Europe on her implementation of the ECHR.

Kroatisch ist eine der drei ¿Nachfolgesprachen¿ des Serbokroatischen. Neben Kroatisch gehören hierzu noch Bosnisch und Serbisch. Politisch gesehen handelt es sich um unterschiedliche Amtssprachen, linguistisch gesehen ist diese Sichtweise kaum haltbar. Trotz einiger Unterschiede in Grafie und Lexik gibt es zwischen Kroaten, Serben und Bosniern eigentlich keine Verständigungsschwierigkeiten. Vielmehr fehlt weitgehend die Bereitschaft miteinander zu kommunizieren. Die gegenseitige Trennung nach dem letzten Bürgerkrieg war und ist rein soziolinguistisch motiviert. Vran¿i¿s ¿Dictionarium¿ erhält als Quelle expliziter kroatischer Sprachhistorie natürlich eine immense ideologische Bedeutung für die Kroaten. Das linguistische Gewicht der Einflussnahme auf spätere Sprachentwicklung wird dagegen in der Linguistik als nicht besonders hoch eingestuft. Dieses liege eher bei späteren Werken. Da es sich immerhin aber um den ersten schriftlichen Nachweis handelt, sei ihm diese diachrone Untersuchung gewidmet.

The content of the book differs from the content of this paper and is not related to the questions posed in this research.1 Part II of this research gives a detailed overview of what security actually means in global politics and how key players understand it. General definitions and theory allows us to understand the major parts of this thesis (part III and IV). Part III describes different approaches to security in IR theory and explains it on the basis of European political integration. The historio-political analysis in this part shows the evolution of a CFSP and the ESDP. Institutionalization processes within the European Union explain the current status of the EU¿s foreign policy, which is a status in process without having a clear and defined goal. This part includes the legal dimension of the EU¿s foreign policy as well and describes the problematic situation Europeans currently have to face, namely disputes about the legal personality of the European Community and the European Union. Part IV is the second major part of the paper and deals with security challenges and the impact of the EU¿s foreign policy on transatlantic relations and/or vice versa. This part has a closer look on the practical side of what the European Union is able and willing to do as a key player in the political, security and military domain in the world. It shows the relations between Europe and the United States and gives a segmentary analysis of Europe¿s power in global politics... ...This research identifies the following specific hypotheses subordinated to the main hypotheses: 1.The European Union will become a global key player in the political and military domain, but will remain at the lower end of high politics for a while (ESDP police missions and military operations). 2.Transatlantic relations in the form of the Atlantic Alliance (or extended atlantic alliance) will remain of essential importance in order to achieve the EU¿s foreign policy goals. 3.Cooperation in the military domain with the United States will remain the only way for Europe during the process of building up a European military.

Since the codification of the jus cogens concept in the Vienna Convention on the Law of Treaties of 1969 the link between international human rights and jus cogens has been clear. This work intents to enlarge the catalogue of international human rights belonging to jus cogens; mainly through the demonstration that the absolute nature of human rights overcomes the arguments against this possibility (e.g. the emergency case clause). This study examines the means by which policies such as the Bush Administration applies in the war on terrorism can be achieved in the United States system of government. It focuses on the legal concepts affected by the Bush Administration’s treatment of alleged enemy combatants after September 11, 2001 by analyzing three lawsuits filed with United States Courts. The three cases—Rumsfeld v. Padilla, Hamdi v. Rumsfeld, and Rasul v. Bush—so far have been the only cases reviewed by the highest court of the nation, the United States Supreme Court.
