This book analyzes the practice of Russia honoring her legal obligations under the European Convention of Human Rights (ECHR): to secure to everyone within its jurisdiction the rights and freedoms defined in the Convention (Article 1 of the ECHR). The study comes to the conclusion that the impact of the ECHR on the Russian legal system, in terms of its implementation by domestic courts, is unsatisfactory. The jurisprudence of the Supreme Court and Supreme Arbitration Court is an attempt to demonstrate to the Council of Europe that the ECHR is being applied, rather than to implement the ECHR. In contrast, the jurisprudence emerging from decisions of the Russian Federation’s Constitutional Court and district courts indicates a better understanding of the spirit of the ECHR. Still, the rare instances in which domestic courts implemented the ECHR were, more often than not, prompted by applicants’ arguments based on ECHR case-law, rather than by the courts. The book suggests methods of ensuring a more effective implementation of the ECHR’s provisions within Russian national law. It develops recommendations on how to assess the Russian government’s compliance with judgments of the European Court of Human Rights, and how to interpret explanations submitted by Russia to the Secretary General of the Council of Europe on her implementation of the ECHR.

The European Union is increasingly facing a dilemma between democracy and technocracy. On the one hand, the EU is today accused for lacking sufficient democratic legitimacy, and on the other, public policy-making is getting more and more complex and technical, making politicians reliant to a certain extent on the technical knowledge of specialised experts. The European Parliament, being the only directly legitimated body within the institutional set-up of the EU and thus the symbol of democracy, plays a key role in this respect. In this book Brigitte Reck analyses the role of expertise for the European Parliament. It is assumed that, in order to fulfil the new challenges posed by its enhanced role in EU decision-making, the European Parliament depends to a high degree on internal and external help in the form of expert knowledge, policy advice and parliamentary assistance. It discovers, mainly on the basis of interviews with politicians and officials in Brussels, which sources of expertise the European Parliament can rely on and to what extent Parliament has adapted its internal capacities to the new challenges arising mainly from co-decision, but also from enhanced complexity. Finally it suggests how to improve the internal expertise capacities of the European Parliament which are necessary if the institution is to bridge the gap between democratic control and good quality outcomes.

Since 1 January 2007, Moldova has been a direct neighbour of the European Union. Nonetheless, Moldova and the Russia-dominated geopolitics of the Black Sea region receive still relatively little attention in the West. This is all the more surprising as there remain a number of consequential political divisions and unresolved conflicts in the area. One of them is the Transnistria conflict in Moldova. This book is a contribution to the, so far, small research and policy agenda on Moldova, and includes findings of several research trips to Moldova, Transnistria and their neighbouring countries. At first, the study reassesses the Transnistria conflict. Contrary to widely held assumptions, this conflict is found to be mainly based on a clash of elites and geopolitical interests rather than on ethnic tensions. The second part of the book analyses the interests, official position, actual impact and potential role of the EU in Moldova's internal separatist conflict and its related external tensions with Russia. So far, the EU has had a limited involvement in the conflict resolution efforts and in the international relations of Moldova. This book concludes that it is becoming increasingly important and possible for the EU to get effectively involved in this region, but that the scope of EU activities in Moldova and Transnistria depends on the country’s relations with, and on the actions in this area of, the United States and Russia. At its end, the study offers recommendations for future EU policies directed at Moldova.

The book series Changing Europe contains edited volumes dealing with current political, economic and social affairs in Eastern Europe and the enlarged EU. The central question addressed by the papers collected in this book is whether trade unions from the post-socialist states have successfully represented their interests at the EU level. The book therefore examines the integration and Europeanisation of a vital part of those societies which joined the EU in 2004. The protection of minorities in Bulgaria presents a paradox. Although minority protection played a prominent role in the accession of the country to the European Union, hardly any positive minority rights were adopted in post-communist Bulgaria. Apart from the reversal of communist assimilation campaigns, only limited progress has been made in the area of minority protection. Positive minority rights have remained very restricted, some minorities, notably Pomaks and Macedonians, have been denied recognition, and the formal adoption of legislation or policy documents has often not been followed by implementation. By charting minority rights policies in Bulgaria in the period between 1989 and 2004, this study clarifies the main reasons for the limited progress in the post-communist period. While, in contrast to some other countries in Central and Eastern Europe, minority “kin-states” did not play a major role in post-communist Bulgaria, the European Union and the Council of Europe were instrumental in putting minority questions on the agenda of Bulgarian governments. However, their impact was smaller than much of the literature on enlargement and conditionality would suggest. Domestic factors were crucial in shaping minority rights policies in post-communist Bulgaria. Of particular importance was the communist legacy, which acted as a brake on the development of minority rights.
