In the war on terrorism, does the United States Judiciary fulfill its critical function to guarantee compliance by the Executive with the political norms and ideals of human rights codified both in the United States Constitution and International Law? This study examines the means by which policies such as the Bush Administration applies in the war on terrorism can be achieved in the United States system of government. It focuses on the legal concepts affected by the Bush Administration’s treatment of alleged enemy combatants after September 11, 2001 by analyzing three lawsuits filed with United States Courts. The three cases—Rumsfeld v. Padilla, Hamdi v. Rumsfeld, and Rasul v. Bush—so far have been the only cases reviewed by the highest court of the nation, the United States Supreme Court.

This book analyzes the practice of Russia honoring her legal obligations under the European Convention of Human Rights (ECHR): to secure to everyone within its jurisdiction the rights and freedoms defined in the Convention (Article 1 of the ECHR). The study comes to the conclusion that the impact of the ECHR on the Russian legal system, in terms of its implementation by domestic courts, is unsatisfactory. The jurisprudence of the Supreme Court and Supreme Arbitration Court is an attempt to demonstrate to the Council of Europe that the ECHR is being applied, rather than to implement the ECHR. In contrast, the jurisprudence emerging from decisions of the Russian Federation’s Constitutional Court and district courts indicates a better understanding of the spirit of the ECHR. Still, the rare instances in which domestic courts implemented the ECHR were, more often than not, prompted by applicants’ arguments based on ECHR case-law, rather than by the courts. The book suggests methods of ensuring a more effective implementation of the ECHR’s provisions within Russian national law. It develops recommendations on how to assess the Russian government’s compliance with judgments of the European Court of Human Rights, and how to interpret explanations submitted by Russia to the Secretary General of the Council of Europe on her implementation of the ECHR.

Und das speziell auch in Zusammenhang mit den Erklärungen in dem 2003 erschienenen Lexikon der Persönlichkeitsmerkmale von Bernhard Waszkewitz. Denn immer wieder lässt sich feststellen, dass die Empfänger psychologischer Gutachten und Beurteilungen diese nicht richtig lesen können, weil sie die gewählten Termini nicht verstehen, sie also infolgedessen falsch interpretieren. Und das führt sowohl bei pädagogischen als auch bei Gerichtsverfahren zu vielfach groben Fehleinschätzungen und ungeeigneten Massnahmen. Ebenso ist nicht zu verkennen, dass viele psychologische Gutachten nicht so richtig der Forderung nach Objektivität gerecht werden, sei es, weil sie stilistisch ungeeignete Akzente setzen, sei es, weil in bester Absicht willkürlich Dominanten gebildet werden oder aber der eine oder andere wichtige Aspekt fehlt, also eine gewisse Unvollständigkeit herrscht. Schon Klages hat geschrieben, dass ein Gutachten ein Kunstwerk ist, doch als solches trägt es oft zu sehr die Handschrift des Verfassers. Und das ist einer sachgerechten Wertung der beschriebenen Tatbestände oft nicht dienlich. Der Forderung nach Objektivität der Interpretation der Befunde kann man nur gerecht werden mit normierten Textprogrammen und Terminitabellen, was allerdings voraussetzt, dass die Verfahrensinterpretationen auf gleicher Basis vorgenommen werden. Actually, the idea of "the inherent dignity and of the equal and inalienable rights of all members of the human family" as laid down in the Universal Declaration of Human Rights of the United Nations is said to have its historic origins in ancient Greek philosophy and Roman law. The first official declarations of human rights, starting with the English Bill of Rights of 1688, all stand in this tradition. Hence, it is not far-fetched when Europeans see themselves as defenders of human rights principles on the international scene. Especially the European Union¿s self-perception has moved in this direction. With the end of the Cold War, the right time seems to have come for politics that increasingly take into account, defend and even fight for such values: the war of the North Atlantic Treaty Organisation with Yugoslavia is only one example of this tendency. But it is a good example, because the "humanitarian catastrophe" that was triggered by Western air-strikes also highlights the fact that the "new Europe" is far from being an examplary place where human rights are widely respected. The essay examines in a critical way the extent to which politics in the pre-9/11 "new Europe" were actually characterised by human rights principles. The foundations of these principles in the "old Europe" will be considered, as well as the double challenge to politics brought about by the fall of the Berlin wall and how this challenge has been met in the 1990s by political institutions (EU's internal and external human rights policies, NATO). The essay concludes with a discussion of the universality claim of human rights in an Western-dominated and internationalised world. The essay critically reviews facts and fiction of European human rights policies on the pre-9/11 international scene.
