Am 25. Februar 2004 wurde von der Kommission der Europäischen Gemeinschaften der Vorschlag für eine Richtlinie über Dienstleistungen im Binnenmarkt vorgelegt. Ihr erklärtes Ziel war die Schaffung eines Rechtsrahmens, durch den die Hindernisse für die Niederlassungsfreiheit von Dienstleistungserbringern und für den freien Dienstleistungsverkehr zwischen den EU-Mitgliedstaaten beseitigt werden und der den Dienstleistungserbringern ebenso wie den -empfängern die notwendige Rechtssicherheit bietet, die diese für die wirksame Wahrnehmung dieser beiden Grundfreiheiten des EG-Vertrags benötigt. Kernstück des Vorschlages war ein konsequent durchnormiertes Herkunftslandprinzip, welches Dienstleistungserbringer grundsätzlich dem Recht und der Kontrolle ihres Heimatlandes unterstellte. Dies wurde insbesondere von Arbeitnehmer-Interessenvertretungen heftig kritisiert. Unter dem Eindruck der breiten Diskussion in den Medien und der Fachöffentlichkeit wurde schliesslich vom Herkunftslandprinzip abgesehen und der Richtlinienvorschlag entschärft. Am 27. Dezember 2006 wurde schliesslich die Richtlinie 2006/123/EG über Dienstleistungen im Binnenmarkt im Amtsblatt der EU kundgemacht; sie ist bis 28. Dezember 2009 in den Mitgliedstaaten umzusetzen. Im Rahmen des Fakultätstages der Rechtswissenschaftlichen Fakultät der Leopold-Franzens-Universität Innsbruck am 8. und 9. November 2006 wurden verschiedene Aspekte der Dienstleistungsrichtlinie auf einem hochkarätig besetzten Symposium erörtert. Neben der Beleuchtung der allgemeinen Rahmenbedingungen wurde die Richtlinie in Beziehung zu ausgewählten Spezialthemen, wie dem Bereich der Rechts- und Finanzdienstleistungen, den Wechselwirkungen zu EWR und Schweiz sowie dem Arbeitsrecht, gesetzt.
