By the end of the middle ages and in early-modern Europe, judges in superior or central courts had risen to a prominent position in society and played a crucial role in legal developments. Whether in the Common Law system or in continental Europe, the courts' decisions became a focus for legal reasoning, forensic arguments and doctrine. Yet, it remains controversial to what extent these developments reflected the emergence of case-law in a modern sense. From a comparative perspective, it is also questionable whether, in spite of obvious institutional and procedural differences, the Common Law and the European Civil Law traditions produced a corpus of judge-made law which, if not by the way it was elaborated, at least by its results in the respective legal systems, played a similar role in the constant interaction between the various sources of law. The present volumes, which are a sequel to the volume "Judicial Records, Law Reports, and the Growth of Case Law" (J. H. Baker ed.), published in 1989, specifically consider the relationship between judicial records and law reports. The emphasis of the contributions is on the techniques applied by the authors of both records and reports. Records, whether in the Common Law tradition or in continental Europe, developed mainly in order to satisfy procedural requirements, whereas the authenticity of early reports did not meet the same standards as in modern times. Both these observations raise the question of the purpose of records and reports in the law-making process. Volume 1 contains essays discussing these questions in the Anglo-American tradition (Common Law, Equity, English Canon Law) and in various continental-European traditions (Italy, France, Germany, the Low Countries and the Roman Catholic Church). Volume 2 illustrates these essays by producing extensive samples of both records and reports in the systems reviewed in the first volume. Thus, the present publication offers the unique combination of scholarly texts which review the latest results of current legal-historical debates on the role of judges' decisions in medieval and early modern law, and, for the first time, a source-book of the courts' practices and the reporters' methods in a wide range of legal systems.

This book deals with the foundations of legal practice in Friesland in the 17th and 18th century, specially with the way in which the Court of Friesland made use of the texts of the ius commune in it's judgements. With the help of the until now unexploited archives of the Frisian Court a selection of civil cases and legal opinions has been made which will not only interest the legal historian but the modern lawyer as well. Legal problems about for example minority, assignment, encumbrances, liability, sale, tort etc. are explained and discussed. The practical solutions of the Court based on Roman law texts taken from the Justinian Corpus Iuris Civilis enlarge the knowledge of the reader and his comprehension of the dogmatic and historical aspects of each case. If possible a comparison with Roman-Dutch law is made and each chapter ends with a reference to modern Dutch laws, illustrating the 'eternity' of the legal problems dealt with. The book also makes clear why the Frisians considered themselves as most tenacious adherents of Roman Law: juris Romani tenacissimi. Convinced of themselves the Frisians members of the Court travelled along the 'pure' Roman highway while the jurists of other provinces and countries often had left the road and taken sidepaths. The book shows us that we in fairness may speak of an independent branch in the big tree of the ius commune: Roman-Frisian law.

The German Yearbook of International Law was founded in 1948 as the "Jahrbuch für Internationales Recht" by Rudolf Laun and Hermann von Mangoldt and is now edited by the Institute for International Law at the University of Kiel. Since its inception it has endeavoured to contribute to the development of international law. Originally it has done this mainly by providing German scholars with an opportunity to publish the results of their works, but increasingly also by offering an international forum. In view of the desirability of obtaining for the Yearbook the largest possible international audience, the editors in 1976 have decided to use the present English title and to accept for publication preferably contributions written in English, or - to a lesser degree - in French. Naturally, the Yearbook also contains contributions written in German. This policy to overcome traditional language barriers appears to have proven successful both in informing the international law community about research done in German academic institutions and in presenting international viewpoints on various topics to the German audience. The Yearbook provides an annual report on the work of international organizations and bodies including the International Court of Justice and the European Court and Commission of Human Rights. Fully aware of the paramount importance of practical aspects in this field, the editors from the beginning also have sought to include contributions from practitioners of international law.

Jan M. Broekman is since 1996 Professor emeritus of Philosophy of Law and Legal Theory at the Catholic University of Leuven (Belgium) and of Philosophy and Medical Ethics at the Vrije Universiteit of Amsterdam (Netherlands).
