This book analyzes the practice of Russia honoring her legal obligations under the European Convention of Human Rights (ECHR): to secure to everyone within its jurisdiction the rights and freedoms defined in the Convention (Article 1 of the ECHR). The study comes to the conclusion that the impact of the ECHR on the Russian legal system, in terms of its implementation by domestic courts, is unsatisfactory. The jurisprudence of the Supreme Court and Supreme Arbitration Court is an attempt to demonstrate to the Council of Europe that the ECHR is being applied, rather than to implement the ECHR. In contrast, the jurisprudence emerging from decisions of the Russian Federation’s Constitutional Court and district courts indicates a better understanding of the spirit of the ECHR. Still, the rare instances in which domestic courts implemented the ECHR were, more often than not, prompted by applicants’ arguments based on ECHR case-law, rather than by the courts. The book suggests methods of ensuring a more effective implementation of the ECHR’s provisions within Russian national law. It develops recommendations on how to assess the Russian government’s compliance with judgments of the European Court of Human Rights, and how to interpret explanations submitted by Russia to the Secretary General of the Council of Europe on her implementation of the ECHR.

Illegal and (lawful, but) harmful content – most notably hate speech and fake news, but also violent videos, copyright infringement, or child pornography – is a crucial problem on digital platforms like Facebook, YouTube, TikTok and Twitter. The EU’s 2022 Digital Services Act aims at tackling this problem by introducing an updated horizontal framework for all categories of content and activities on intermediary services. This raises several questions. How far do – national and European – free speech guarantees go? If hate speech can be banned to protect the victims’ rights, how can the prohibition of fake news be justified? What is the remaining leeway of the platforms for private content moderation? Who is responsible for fighting and taking down illegal content? How can the victims of de-platforming, content takedowns or shadow banning claim their right to freedom of opinion? Finally, how will these legal responsibilities be enforced? These questions are addressed in the articles of the edited volume, proceeding from the 2022 Annual Conference of the Institute for Digital Law Trier (IRDT).

Deutlich später setzt der breite Strom der mit grossem Prestige ausgestatteten Rechts- oder Moralliteratur ein, der - wiederum beiläufig - ein in seinen Grundzügen kohärentes Bild vom Königtum, von Recht und Staat vermittelt. Dessen Realität ist jedoch immer wieder in Zweifel gezogen worden - nicht zuletzt durch die Texte selbst. Obwohl sie sich normierend geben, reden sie gelegentlich der Pluralität, den Lokaltraditionen das Wort. Die seit dem Mittelalter reichlicher fliessenden inschriftlichen Quellen zeigen dann auch regional unterschiedliche Systeme - kaum verwunderlich angesichts der Ausdehnung und kulturellen Vielfalt des Subkontinents. Dazu kommen Partikularrechte einzelner religiöser Gruppen, únd die Akkulturation durch den sich ausbreitenden Hinduismus in mannigfachen Mischformen. All das dokumentiert den mühseligen Prozess der Auseinandersetzung zwischen "Lokalbrauch" und der Begrifflichkeit der Orthodoxie.
