Essay from the year 2002 in the subject Law - European and International Law, Intellectual Properties, grade: 1 (A), University of Kent (Kent Law School), language: English, abstract: The conflict between Israel and the Palestinians over the occupation of the West Bank and Gaza is one of the most complicated conflicts in the world. Attempts to resolve the conflict have failed in the past and a resolution seems unlikely to emerge in the near future. Partly, this is due to the fact that the situation is extremely complex and the conflict very old. History, politics and international law together with religion, nationalism and pride are entangled to form this conflict. For both sides the conflict has reached an emotional level where belief is more important than rational decisions. A lot has been written about the Israel-Palestine conflict and in recent years more and more critique of Israel has emerged. This is particularly interesting as usually every criticism of its actions or policies is turned down by Israel as anti-Semitism. One thus has to be extremely careful when writing about Israel although international law seems to be relatively clear about the 1967 occupation of Gaza and the West Bank. In order to examine the legality of the occupation, this paper will discuss the situation from both angles and look at the sources of international law relevant to this case. These are the Charter of the United Nations in general and the United Nations Security Council Resolution 242 in particular. In addition, customary international law has developed to a jus cogens, prohibiting the use of force at all for settling international disputes. Finally, this paper shall conclude that any justification of the occupation is doubtful and there is little evidence in international law that might legitimise Israel¿s actions. And even if the initial occupation could be legitimised under Article 51 of the UN Charter as an act of self-defence, the prolonged occupation would still lack any legal basis.

It has achieved "the enhanced status [¿] as the dominant world language [which] has led to an increased demand for the training of competent specialists able to mediate" (Alcaraz Varo/Hughes, 2002: 1). This goes along with a "phenomenal increase in the teaching of [¿] 'English for special (or specific) purposes' " (ibid.: 2). What is the reason for this development? This piece of work might give an answer; it dedicates itself to domain specific English language: language and law. It concentrates on the characteristics of the structure of legal English in particular. An overview of the central structural features is given, without claiming completeness. Legal professionals aim at a precise explanation of facts which should leave no doubts. This aim forces them to use a certain kind of language pattern, such as including a high amount of definitions in legal texts, along with numerous complex and ancient phrases deriving from Law French and plentiful enumerations which can all together form a single sentence covering several lines. Dependent on which party they represent, lawyers make frequent use of features that reduce the agent in his identity while emphasizing the action ¿ a matter of strategy which has the impeding of comprehension as a consequence. Therefore, the field of law becomes completely unapproachable for laymen, who are scarcely able to follow legal discourse. Even well-educated native speakers often find it hard to understand the language used in court. However, the access to one¿s rights is important. To begin with, the reader will be provided with an overall definition of special languages and an explanation why to regard them as a variety of a language; afterwards this will be illustrated at the example of the language of the law. Subsequently, the foundations for the structural analysis of legal English will have been laid. Language has to serve as the vehicle for transporting what the law is about. But legal language does not seem to be a good packaging of legal contents. That is why experts are asked to diminish the barrier and mediate between the language of the law and common speech. Does legalese function as an obstacle rather than a vehicle then? This question will have to be considered in this piece of work. An effective corporate rescue procedure is a cornerstone of a prospering economy. Economical value is closely connected to the risk of economic loss. Therefore, economic growth will only be sustainable if investments are supported by safeguards donated by effective insolvency regimes not only focussing on a fast liquidation but also on the reorganisation or rescue of a company. Only the careful balance of creditors¿ rights and the entrepreneurial spirit of the debtors ensure attractiveness for investments.(3) B Comparative approach This essay is focussed on the administrator as point of comparison because his role in the process significantly reflects the principles of the underlying corporate rescue regime. In both countries Australia and Germany the administrator is a relatively influential organ. The essay will show that the role of the German administrator is much more influenced by the court than in Australia. The essay¿s goal is to examine selected issues concerning the Australian and German administrator. They are used to watch people's activities and behaviour and, if necessary react towards crime or anti-social behaviour. The UK is by far the most advanced country in Europe in regards to public surveillance research and installation. In the last decade the coverage has grown dramatically. In 1990 there were three town centre schemes with approximately 100 cameras and in 2002 there were approximately 500 schemes with around 40,000 cameras. The impression can be made that it is used as a general tool to prevent crime and promote a safer and cleaner community. But is it as effective as it promises to be and to what extent does it effect people's perception and activity in neighbourhoods and cities? To what extent does CCTV influences the urban designer work? What needs to be considered when implementing CCTV in existing and new developments? This paper will help to understand the complexity of this question and issues related with its context. One approach to the topic lays in the question: Why do people feel scared and insecure in public areas? The 'fear of crime' has become an important issue to consider within urban design and town planning. Being afraid of being a victim of crime can be positive if it leads to increased crime prevention, but it can also affect people's quality of life in a negative way. This fear gets projected on the appearance of places and their users which lead towards banning beggars and on-street traders. In the argument about public surveillance, it is often mentioned that constant camera monitoring is reducing this 'fear of crime'.
