Art. 187 Abs. 2 IPRG). Ein Billigkeitsentscheid kann vereinfacht als Entscheid unter Berücksichtigung der Einzelfallgerechtigkeit beschrieben werden, der im Vergleich zu einem an eine bestimmte Rechtsordnung gebundenen schiedsgerichtlichen oder gerichtlichen Entscheid oft schneller und einfacher zu fällen ist. Der Autor zeigt auf, dass die Parteien den Schiedsrichter nicht nur zu einem Billigkeitsentscheid in materiellrechtlicher Hinsicht ermächtigen können, sondern auch eine verfahrensrechtliche Billigkeitsermächtigung zulässig ist. Die vorliegende Dissertation behandelt nach einer kurzen historischen Einleitung den schiedsgerichtlichen Billigkeitsentscheid im schweizerischen Rechtssystem. Im Mittelpunkt stehen dabei einerseits die parteiautonomen Grundlagen eines Billigkeitsentscheides, namentlich die Schieds- und Billigkeitsvereinbarung. Andererseits werden die materiellen und verfahrensrechtlichen Grenzen beleuchtet, welche ein Billigkeitsschiedsrichter bei seiner Entscheidfällung zu beachten hat.
