Das lässt sich leicht aus Deweys wissenschaftlichen Schwerpunkten erklären: Denn gerade pädagogische und philosophische Fragen waren es, mit denen sich Dewey am meisten beschäftigt hat, so zum Beispiel in einem seiner bekanntesten Bücher, ¿Democracy and Education¿. Aber auch für die Politikwissenschaft gibt es bei Dewey durchaus Anknüpfungspunkte, und zwar insbesondere in seiner Theorie der Demokratie. In Deutschland hat besonders Hans Joas zu einer Verbreitung von Deweys Gedanken beigetragen. In dieser Hausarbeit soll ein bisher noch wenig berücksichtigter Aspekt von Deweys Demokratietheorie, nämlich sein Öffentlichkeitsbegriff dargestellt und interpretiert werden. Dewey hat seine Gedanken zum Thema Öffentlichkeit in einem Essay mit dem Titel ¿The Public and its Problems¿ verarbeitet. Der Essay entstand aus Deweys Auseinandersetzung mit einem Buch von Walter Lippmann. In Lippmanns Buch ¿The Phantom Public¿ wird ein zunehmendes Versagen der demokratischen Kontrolle der Regierung konstatiert. In einer immer komplexer organisierten Gesellschaft könne der Bürger viele Fragen überhaupt nicht mehr sachgerecht entscheiden. Auch viele andere Politikwissenschaftler und Kulturkritiker waren skeptisch gegenüber der modernen Massendemokratie und wollten sie durch eine stärker von Experten gelenkte Regierungsweise ersetzen. Gegen diese Position hat sich Dewey immer gewandt: Die Prinzipien der Wissenschaft sind für ihn, wie er in ¿The Public and its Problems¿ deutlich macht, mit denen der Demokratie insofern identisch, als sie beide auf freier Kommunikation beruhen. Eine wissenschaftliche und rationale Steuerung der Gesellschaft und ihre Demokratisierung schliessen sich nach Dewey keineswegs aus. Im Gegenteil: Dewey versteht die Entstehung der Demokratie gerade als Fortschritt im rationalen Selbsterkenntnisprozess der Gesellschaft. In dieser Hausarbeit soll zunächst Deweys Gedankengang dargestellt werden. Sondervermögen, Eigenbetriebe) durch privatrechtlich organisierte Unternehmen ersetzt, und auch im Verwaltungsbereich der Kommunen wurden immer mehr öffentliche in privatrechtliche Organisationsformen umgewandelt.1 Daraus sind sowohl Privatrechtsunternehmen im alleinigen Besitz der öffentlichen Hand entstanden, als auch Mischformen ¿ so genannte Public Private Partnerships ¿ bei denen zu dem öffentlichen Eigner auch private Anteilseigner hinzukommen.2 Als Begründung für diese Vorgehensweise ist häufig das Argument des Effizienzvorteils zu finden.3 Der privatrechtliche Unternehmensbereich des Staates, der überwiegend kommunale Aufgaben erfüllt, unterliegt aber kaum einer parlamentarischen Steuerung und Kontrolle.4 Wenn der Staat in öffentlich-rechtlichen Organisationsformen handelt, gibt es Regel- und Kontrollmechanismen, die ausschliesslich auf den Eigner öffentliche Hand ausgerichtet sind. Diese gelten aber nicht, wenn er in Privatrechtsform tätig ist. Ausserdem kommt bei einer privaten Kapitalbeteiligung der immanente Konflikt zwischen der Erfüllung der öffentlichen Aufgabe einerseits und dem Gewinninteresse der privaten Eigner andererseits hinzu.5 Somit ist der Unternehmenskontrolle bei Privatunternehmen im Eigentum der öffentlichen Hand gesteigerte Aufmerksamkeit zu widmen. Es besteht die Gefahr, dass zum Teil bewusst Einbussen bei den Kontrollrechten hingenommen werden, da die Formprivatisierungen und die Beteiligung von Privaten durch den finanziellen Handlungsdruck der Politiker bestimmt werden.6 Die beteiligten Akteure können zu ihren eigenen Gunsten und auf Kosten der übrigen Bevölkerung handeln, wenn keine verantwortungsvolle Kontrolle stattfindet,7 obwohl der Staat für das ihm von den Bürgern überlassene Staatsvermögen nur eine treuhänderische Funktion besitzt.8 In dieser Arbeit soll nun betrachtet werden, welche Probleme und Defizite hinsichtlich der Unternehmenskontrolle bei Privatunternehmen im alleinigen und teilweisen Eigentum der öffentlichen Hand bestehen, welche Lösungsansätze diskutiert werden und welche Verbesserungen sinnvoll erscheinen.

When Sherlock Holmes met his demise in The Adventure of the Final Problem, published in 1893, the distress of the unsuspecting reading public was profound. Eventually, Doyle saw fit to continue his Holmes' canon and wrote a series of thirteen short stories - The Return of Sherlock Holmes - published in 1905. The series begins, inevitably, with the shock re-appearance of the master detective in The Adventure of the Empty House. This, plus three others are included in Naxos AudioBooks' first volume of Doyle's continuation of the famous bloodhound-of-a-genius, read by master storyteller David Timson. Though he has been away, it seems that Holmes has lost none of his remarkable qualities.
