Essay from the year 2002 in the subject Law - European and International Law, Intellectual Properties, grade: 1 (A), University of Kent (Kent Law School), language: English, abstract: The conflict between Israel and the Palestinians over the occupation of the West Bank and Gaza is one of the most complicated conflicts in the world. Attempts to resolve the conflict have failed in the past and a resolution seems unlikely to emerge in the near future. Partly, this is due to the fact that the situation is extremely complex and the conflict very old. History, politics and international law together with religion, nationalism and pride are entangled to form this conflict. For both sides the conflict has reached an emotional level where belief is more important than rational decisions. A lot has been written about the Israel-Palestine conflict and in recent years more and more critique of Israel has emerged. This is particularly interesting as usually every criticism of its actions or policies is turned down by Israel as anti-Semitism. One thus has to be extremely careful when writing about Israel although international law seems to be relatively clear about the 1967 occupation of Gaza and the West Bank. In order to examine the legality of the occupation, this paper will discuss the situation from both angles and look at the sources of international law relevant to this case. These are the Charter of the United Nations in general and the United Nations Security Council Resolution 242 in particular. In addition, customary international law has developed to a jus cogens, prohibiting the use of force at all for settling international disputes. Finally, this paper shall conclude that any justification of the occupation is doubtful and there is little evidence in international law that might legitimise Israel¿s actions. And even if the initial occupation could be legitimised under Article 51 of the UN Charter as an act of self-defence, the prolonged occupation would still lack any legal basis.

Mit dem Settlement-Agreement, welches Google am 28.10.2008 mit den in den USA gegen das Bibliotheksprojekt klagenden Autoren- und Schriftstellervereinigungen schloss, rückte das Google Bibliotheksprojekt im Jahr 2009 erneut ins Blickfeld des allgemeinen Interesses. Das Hauptaugenmerk einer Prüfung der Vereinbarkeit des Bibliotheksprojekts mit deutschem Urheberrecht liegt auf der Frage, ob bereits das Anzeigen kurzer Textauszüge (sogenannter Snippets) aus einem Werk als Suchergebnis rechtsverletzenden Charakter hat. Eine wichtige Rolle spielt hierbei das Zitatrecht. Ziel der Darstellung ist es weiterhin, die Rolle des Urheberpersönlichkeitsrechts zu beleuchten. Den Schwerpunkt der Untersuchung des US-amerikanischen Rechts bildet die Fair Use-Analyse. Auch in Bezug auf das US-amerikanische Recht wird die persönlichkeitsrechtliche Komponente des Falls untersucht.

Nach einer Einführung in das Modell der REITs werden die indirekten Immobilienanlageprodukte, Offene Immobilienfonds und Immobilienaktiengesellschaften betrachtet. Dabei wird nach einer modellhaften Vorstellung ein Vergleich zum REIT anhand von qualitativen und quantitativen Eigenschaften durchgeführt. Anschliessend folgt eine Analyse der REIT-Modelle bedeutender Länder. Unter Nutzung dieser Ergebnisse wird ein Modellvorschlag für einen deutschen REIT (G-REIT) gegeben. In Verbindung dazu werden auch bereits existierende Konstruktionsvorschläge aufgeführt.

On paper, international HIV/AIDS policy appears to be well-coordinated. The Millennium Development Goals set specific, time-bound targets for HIV/AIDS. Various global health partnerships, e.g. UNAIDS, coordinate the work of public, private and civil society sector actors. In reality, however, very little coordination between the multitude of actors takes place. This study provides recommendations to one of these actors - the German Federal Health Ministry - for positioning itself in Eastern Europe, in particular in the Ukraine, the Russian Federation and Estonia. A particular focus is placed on different coordination mechanisms, whereby the benefits and costs of the coordination strategies are analysed in terms of their effectiveness, efficiency and sustainability. The study concludes that different countries not only require different HIV/AIDS policies, but also require different coordination strategies. Estonia, Russia and the Ukraine require not only different policies in terms of the comprehensiveness of policies. Engagement in the three countries also needs to differ with regard to the time horizon (short or long term) and whether existing networks can or should be used.
