Der Welthandel ist nicht allein ein Handel zwischen Staaten. Vielmehr sind es überwiegend private Akteure, die über die nationalen Grenzen hinweg Waren und Dienstleistungen kaufen und verkaufen. Durch Staaten errichtete Handelshemmnisse haben daher erhebliche Auswirkungen auf einzelne Bürger und Unternehmen. Gleichwohl bestehen nur wenige Möglichkeiten für Privatrechtssubjekte, gegen WTO-widrige Massnahmen des eigenen Staates oder von Drittstaaten vorzugehen. Der Verfasser untersucht, vergleicht und bewertet die Mechanismen, die im US-Amerikanischen und im EG-Recht zur Verfügung stehen, um WTO-Recht mittelbar durchzusetzen, sowie die unmittelbare Wirkung des WTO-Rechts in den U.S.A. und in der EG. Nach der Analyse und Bewertung des Status Quo macht der Autor ausserdem Vorschläge, wie eine Weiterentwicklung des Rechtsschutzes aussehen könnte, die zugleich die in den U.S.A. und der EG gegen eine weitergehende Wirkung des WTO-Rechts vorhandenen Bedenken berücksichtigt. Letztlich wird in beiden Rechtsordnungen die Rechtslage durch den Reziprozitätsansatz geprägt. Einseitige Zugeständnisse wird es daher nicht geben, selbst wenn die wirtschaftstheoretische Uberzeugung vorherrscht, dass ein solcher Schritt für alle Beteiligten langfristig vorteilhaft wäre. Nur wenn ein Rechtsschutzsystem eingeführt wird, das den Souveränitätsanspruch der Staaten achtet und ein »level playingfield« schafft, könnte der Ubergang von machtorientierten zu einem normorientierten Welthandelssystem auch für Privatpersonen gelingen.

Bereits im Jahre 1973 wurde in den USA ein unabhängiger privater Standardsetter, das Financial Accounting Standards Board (FASB), gegründet. Nach diesem angloamerikanischen Vorbild schuf man später auch in anderen Ländern wie Deutschland solche privatrechtlichen Gre-mien, um die Rechnungslegung zu vereinheitlichen und um Regelungslücken zu schliessen. Hierbei war die Erkenntnis, dass eine Harmonisierung schneller und präziser durch ein unabhängiges, mit Sachverständigen besetztes Gremium als durch den Gesetzgeber erfolgen kann, massgeblich. Die Schaffung des IASC im Jahre 1973 war ein erster Schritt in Richtung einheitlicher Regelungen abseits von geografischen Gegebenheiten. Heute ist die Einhaltung der IFRS in Deutschland für kapitalmarktorientierte Unternehmen, die nicht nach US-GAAP aufstellen, seit dem 01.01.2005 vorgeschrieben. Auch die Neuorientierung des Deutschen Rechnungslegungs Standards Committee (DRSC) im Jahre 2003 und dessen seitdem verstärkte Ausrichtung der Arbeit auf die Vertretung der deutschen Wirtschaft in internationalen Standardisierungsgremien ist ein Indiz für die sich vollziehende internationale Harmonisierung der Rechnungslegung. Der Begriff Standard bezeichnet eine Norm oder Richtschnur.
