Essay from the year 2002 in the subject Law - European and International Law, Intellectual Properties, grade: 1 (A), University of Kent (Kent Law School), language: English, abstract: The conflict between Israel and the Palestinians over the occupation of the West Bank and Gaza is one of the most complicated conflicts in the world. Attempts to resolve the conflict have failed in the past and a resolution seems unlikely to emerge in the near future. Partly, this is due to the fact that the situation is extremely complex and the conflict very old. History, politics and international law together with religion, nationalism and pride are entangled to form this conflict. For both sides the conflict has reached an emotional level where belief is more important than rational decisions. A lot has been written about the Israel-Palestine conflict and in recent years more and more critique of Israel has emerged. This is particularly interesting as usually every criticism of its actions or policies is turned down by Israel as anti-Semitism. One thus has to be extremely careful when writing about Israel although international law seems to be relatively clear about the 1967 occupation of Gaza and the West Bank. In order to examine the legality of the occupation, this paper will discuss the situation from both angles and look at the sources of international law relevant to this case. These are the Charter of the United Nations in general and the United Nations Security Council Resolution 242 in particular. In addition, customary international law has developed to a jus cogens, prohibiting the use of force at all for settling international disputes. Finally, this paper shall conclude that any justification of the occupation is doubtful and there is little evidence in international law that might legitimise Israel¿s actions. And even if the initial occupation could be legitimised under Article 51 of the UN Charter as an act of self-defence, the prolonged occupation would still lack any legal basis.

Heute wird Chowanschtschina zumeist in einer weiteren Überarbeitung von Dimitri Schostakowitsch aufgeführt, die erstmalig 1960 wiederum in St. Petersburg stattfand, das zu dieser Zeit Leningrad hiess. Die brutale und dramatische Handlung der Oper spielt im Russland des ausgehenden 17. Jahrhunderts, das damals in einer tiefen Regierungs- und Religionskrise steckte, von der die gesamte russische Gesellschaft betroffen ist und die letztendlich zur Regierung von Peter dem Grossen führte. Regisseur Stein Winge hat Mussorgskis Oper, die hier in der Version von Schostakowitsch aufgeführt wird, mit seiner kompromisslosen und dramatischen Produktion kraftvoll modernisiert. Die herausragende, vorwiegend russische Besetzung sowie das Orchester und der Chor des Gran Teatre del Leceu Barcelona wurden im Surround-Sound und mit High-Defnition-Kameras aufgenommen.

This paper expands on the topic of Bryson¿s view both of Great Britain and the United States of America by means of national stereotyping as it emerges from his novels Notes from a Small Island (1995) and Notes from a Big Country (1998). I maintain that Bryson depicts Britain and America in an authentic and educative as well as hilarious and exaggerated manner to emphasize differences between the nations in question. I will prove my thesis that Bryson both criticises and praises British and American values which affect the national character. Bryson conveys his national views both from the perspective of an insider and outsider. William ¿Bill¿ McGuire Bryson was born in Des Moines, Iowa, in 1951. In 1973, he travelled to England where he became acquainted with his wife, Cynthia Billen, with whom he has four children. Bryson lived in Yorkshire, returned to America to graduate in 1995, and resided with his family in Norfolk, in 2003. While in America Bryson is well-known for elaborating on the English language, he accomplished bestseller standing with travelogues in Great Britain. Although he claims not to be a travel writer because he ¿stumbled into this genre¿, Bryson composes ¿books on travel and the English language¿ in which his ¿wanderlust and eccentricity¿ promise a unique reading adventure (Oder 191). Travel writing is a neglected but miscellaneous genre of ancient times which flourished in the sixteenth century and encompasses narratives of expansionism, such as encyclopaedic accounts of foreign nations, and became the principal negotiator of propagating stereotypes in colonial novels. While Bryson¿s journey novel Notes from a Small Island depicts the Great Britain he adores, he grudgingly wrote columns about America which resulted in his journalistic novel Notes from a Big Country.

It is also evident that certain brand dimensions and associations lead to increased marketplace recognition and economic success for brand owners, as a result the value consumers place on them. Marketers spend millions of dollars each year to identify well defined, strong brand images and to support them. A company¿s economic superiority is frequently implied by the strength of its brand name giving it the ability to differentiate itself and improve its competitiveness. (Nykiel, 1997) Park, Jaworski and MacInnis (1986) noted that consumer needs could be classified in functional or symbolic needs. The functional needs are related to specific and practical consumption problems, whereas symbolic needs are related to self image and social identification. (Subodh Bhat, 1998) Therefore they mentioned that all brand should have a ¿brand concept¿, which is an overall abstract meaning that identifies a brand. Also, there are different types of motivations among each individual, and these motivations drives their needs either to be functional or symbolic in nature. Thus, functional needs of consumers could be exploited with a functional brand, one positioned with a functional brand concept. A brand could be also positioned as a ¿symbolic¿ brand for consumers who whish to enhance their self image or their social image. (Park, 1991)

On one hand he was celebrated as the "Poet of the American Revolution" (Eberwein 191) or the "Father of American Poetry" (Stauffer 52), a journalist of influence, a patriot and skilful writer, on the other hand he was forgotten for a long time. How did Philip Freneau see himself? What were his targets and how did he try to reach them? This paper examines Freneau's look on his role as an author on his poetry and plans. What kind of influences affected or promoted his career? Regarding his own poems "To an Author", "The City Poet" and "To a New England Poet" his description of an author's life - and therefore his life - will become apparent. Furthermore, a closer look on his contemporaries, the Connecticut Wits, especially Dwight, Barlow and Bryant will display how independent and original Freneau's writing was, and what kind of relationships he had towards these American authors. At the same time his relationship towards British poets is interesting: He thought he rejected most of their writing; but was he really not influenced by them at all? Could it be that he sometimes even copied parts of their work? After having a short look on other intertextual influences like Greek mythology, verses from the Bible and Classic forms, this paper will look back on his life in a retrospective way and analyse his attitude towards himself. Did Freneau manage to reach his goals or did he lose sight of them?

In this research paper I want to explore how the use of different narrative techniques correlates with and indicates the protagonist¿s development towards both an artist and an autonomous adult. Except of the concluding diary entries, the novel is narrated by a third-person narrator who has got a limited point of view since he is focalized through Stephen. The narrator presents Stephen¿s consciousness and activities in various ways; an important aspect about his narration is that he persistently adapts his style to Stephen¿s idiom and mood. In some passages the narrator reports almost objectively on events, however, often he renders Stephen¿s consciousness, for which he uses different narrative techniques. Since Dorrit Cohn is thought to be one of the most important researchers on the field of narrative techniques concerning the presentation of consciousness, I will base this research paper on her definitions. Cohn distinguishes three ways a third-person narrator can use for rendering a person¿s consciousness: psycho-narration, narrated monologue and quoted interior monologue, all of which are used in the novel. I will focus on psycho-narration and narrated monologue since these are the techniques predominantly used. Psycho- narration is the narrator¿s description of a character¿s thoughts and feelings, thus, it is the most indirect way of rendering a character¿s consciousness. The third-person reference and the tense of narration are maintained. The presence of a narrator is marked since a verbum dicendi is always used. Narrated monologue uses the third person singular and the preterite as well; however, at the same time the syntactical structure remains that of direct discourse with exclamations, questions, repetitions, interjections and exaggerated emphases. The effect of narrated monologue is to reduce as far as possible the distance between the narrator and the character existing in all third person narrations. Since psycho- narration and narrated monologue use a third-person narrator and the same time span, the two techniques can alternate without perceptible transitions. As a result, the narrator can weave in and out of the character¿s thoughts and the distance between narrator and character can be eliminated.

The overall market situation is dominated by increasing pressure on cost and productiveness. The global market trend forces a high company concentration that strengthens market positions. Lufthansa - Germany¿s national carrier was faced, like all other national carriers with the above-mentioned problems and had to find its way out of the crisis. The central question of this report is: With which tools did Lufthansa solve these problems? And are these tools sufficient to be competitive for future developments? This report paper is dealing with the developments in airline business illustrated with the example of Germany¿s national carrier, the Lufthansa AG, and the enormous company restructuring toward an ideal global player in a highly competitive environment. By analysing the internal and external influences, pressuring the company to adapt, the need of change by Lufthansa will be made more comprehensible. The learning organisation and the role of creativity have become more important during the last decades, especially in fast changing environments like the airline industry where Lufthansa operates. This will be a special regard in chapter four. In the last section of the report a critical analysis will be made on the effectiveness of the organisation¿s response, and some areas of improvement will be mentioned.
