Die Konzeption: Dieser neue Klausurenkurs für den Schwerpunktbereich Arbeitsrecht ist aus mittlerweile neun Jahren Unterricht im Schwerpunktbereich Arbeit, Wirtschaft und Soziales an der Bucerius Law School in Hamburg hervorgegangen. Bei den zehn Klausuren des vorliegenden Bandes handelt es sich ganz überwiegend um originale Examensklausuren (mit Ausnahme der Übungsklausuren 9 und 10). Aus diesem Grund sind sie zumeist nicht – wie reine Übungsklausuren – auf einen einzelnen arbeitsrechtlichen Themenkomplex beschränkt, sondern prüfen eine Mischung examensrelevanter Fragestellungen ab. Mit dem vorliegenden Band wird aber auch und vor allem das Anliegen verfolgt, den Studenten zur Vorbereitung auf das Examen Musterlösungen an die Hand zu geben, die den Formulierungsanforderungen im Examen entsprechen. Daher wurde jede einzelne Fall-Lösung so formuliert, wie es in einer originalen Examensklausur von den Bearbeitern erwartet wird. Ein Whistleblower ist also ein Hinweisgeber. In den USA, in Frankreich und in Grossbritannien werden Arbeitnehmer zur Aufdeckung von Missständen ermutigt und gesetzlich geschützt. In den USA werden die Whistleblower vom Staat regelrecht als Klageinitiatoren benutzt und prozentual an Strafzahlungsforderungen gegen die angezeigten Unternehmen beteiligt. In den USA sind 90% der Betrugsklagen im medizinischen Bereich sog. qui tam actions, also Klagen, bei denen der Kläger für den Staat und gleichzeitig aus Eigeninteresse handelt. In Deutschland gibt es trotz mehrerer Gesetzesinitiativen bis heute noch keine allgemeine gesetzliche Privilegierung. Die Bundesregierung ist der Meinung, dass Whistleblower durch die bestehenden arbeitsrechtlichen Regelungen und die Rechtsprechung hinreichend geschützt seien und macht ihr weiteres Vorgehen von dem Ergebnis und den Empfehlungen einer Arbeitsgruppe der G20-Staaten zum Schutz von Hinweisgebern bei Korruptionsstraftaten abhängig. Es lässt sich wahrscheinlich auch mit der deutschen Geschichte (Nationalsozialismus und Stasi) erklären, dass hierzulande zurückhaltender mit dem Thema umgegangen wird. Es scheint, als hätten viele noch das Zitat von Hoffmann von Fallersleben "der grösste Lump im ganzen Land, ist und bleibt der Denunziant", im Kopf.

Für den Gerichtshof der Europäischen Gemeinschaften zeichnet dessen Präsident Vassilios Skouris spezifische Grenzen beim Vorabentscheidungsverfahren, in der Grundrechtsjudikatur und bei der Gerichtsorganisation nach. Aus Sicht des Generalanwalts bestimmt Francis Jacobs die Position des EuGH zwischen Staats- und Völkerrechtsordnung samt der ihnen zugeordneten Gerichte. Die von beiden Autoren betonte Kooperation sieht Hans-Jürgen Papier, Präsident des Bundesverfassungsgerichts, im Verhältnis zum EuGH als verwirklicht an. Spannungen bestehen zwischen Karlsruhe und dem Europäischen Gerichtshof für Menschenrechte.
